www.padelwerk.ch is a website for those interested in ball sports games such as padel, pickleball, badminton or football. Padelwerk also offers other services that can be found on the website. You can visit the Padelwerk website without registering. In this case, Padelwerk collects at most the following data:

• date and time of contacting our website;
• IP address of the computer (client) accessing our website and, if recordable, its domain name or the name of the internet service provider;
• name of the page from which our site or data from our site was requested;
• type and operating system of the web browser used;
• access status (page transmitted, page not found, etc.);
• data from cookies and similar technologies (see sections 1.7 and 1.8);
• information provided by you.

The controller responsible for processing your personal data on this website is Padelwerk AG, Hochbergerstrasse 60F, 4057 Basel, Switzerland (registered office in Münchenstein, UID CHE-401.076.657). Please send questions about data protection and requests concerning your data to hallo@padelwerk.ch.

We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP). Where the EU General Data Protection Regulation (GDPR) applies, for example to visitors from the EU, we rely on the following legal bases:

• your consent (Art. 6(1)(a) GDPR), for example for statistics, marketing and the newsletter;
• the performance of a contract or pre-contractual measures (Art. 6(1)(b) GDPR), for example for enquiries and orders;
• legal obligations (Art. 6(1)(c) GDPR);
• our legitimate interest in a secure, functioning and user-friendly website (Art. 6(1)(f) GDPR).

You do not book courts on this website but on our booking platforms Arenakey (arenakey.app) and Playtomic (playtomic.com). Clicking “Book” redirects you there. The privacy policy of the respective provider applies to the data collected during registration and booking. By using the booking platforms, you consent to your data being transmitted between Padelwerk and Arenakey or Playtomic.

So that we can see which advertisement or page led to a booking, we pass on the campaign details from the address (utm parameters, gclid, fbclid) when you switch to Arenakey. For this purpose we keep them in your browser’s storage (sessionStorage) only for the duration of your visit. If you have allowed statistics, Google Analytics links your visit to this website with your visit to arenakey.app (cross-domain measurement, see section 1.8).

When you write to us via a form (for example contact, partnership, franchise, Arenakey for operators, membership for teams and schools or registration for an event), we process the details you enter, such as name, email address, phone number, company, location and your message, as well as the language, page and time of the enquiry. We store every enquiry in our own management system (see section 1.9) and forward it to our team by email. You receive a confirmation by email. We send these emails via Mailchimp Transactional (Mandrill) of The Rocket Science Group LLC, an Intuit Inc. company, USA.

To prevent misuse, we briefly count submissions per IP address in the server’s memory. The IP address is not stored.

For the newsletter we need your email address and, if you provide it, your name. We store your subscription with the time, language and wording of the consent notice in our management system and pass on your email address, name, language, time and IP address of the subscription as proof to Mailchimp (The Rocket Science Group LLC, an Intuit Inc. company, USA), which we use to send the newsletter. Mailchimp may record whether a newsletter was opened and which links were clicked. The basis is your consent. You can unsubscribe at any time via the unsubscribe link in every issue or by email to hallo@padelwerk.ch.

Products, prices and images in our shop come from Shopify. Your browser loads the product images directly from Shopify (cdn.shopify.com), which means Shopify receives your IP address. When you add an item to the cart, Shopify manages the cart; your browser communicates directly with Shopify for this, and we only keep the cart identifier in a cookie (see section 1.7). Ordering, payment and shipping are handled by the Shopify checkout at shop.padelwerk.ch. The shop’s privacy policy and Shopify’s terms also apply there. The provider is Shopify International Limited, Ireland; Shopify also processes data in Canada and the USA.

On your first visit, our cookie notice asks which categories you allow: necessary (always active), preferences, statistics and marketing. We store your choice with the date in your browser (localStorage, entry “pw-cookie”) so that the notice does not appear on every visit. You can change or withdraw your choice at any time in the cookie settings.

Without consent we only set what is necessary to operate the website:

• “pw-cookie” (localStorage): your choice in the cookie notice;
• “NEXT_LOCALE” (cookie): the selected language;
• “pw_warenkorb” (cookie, 14 days): the identifier of your shop cart;
• campaign details for the duration of the visit (sessionStorage, see section 1.3).

Cookies from Google and Meta (such as “_ga”, “_ga_” with an identifier and “_fbp”) are only set with your consent to statistics or marketing (see section 1.8).

We use Google Tag Manager from Google Ireland Limited, Ireland (with Google LLC, USA), to integrate the following services. Both follow your choice in the cookie notice (Google Consent Mode v2):

• Google Analytics 4 (statistics category): measures which pages and locations are visited and which booking, contact and shop steps are triggered. With your consent, Google sets cookies (“_ga”, “_ga_” with an identifier) and can recognise returning visits. Without consent, Google sets no cookies and only receives cookieless signals (such as page view and consent status); your IP address is technically transmitted in the process.
• Meta Pixel (marketing category) from Meta Platforms Ireland Limited, Ireland (with Meta Platforms, Inc., USA): measures whether visitors visit our website, start a booking, add something to the cart or submit a form after seeing an ad on Facebook or Instagram, and helps us target advertising. The Meta Pixel only loads with your consent to marketing and then sets the “_fbp” cookie.

We do not pass on names, email addresses or phone numbers to these services.

For visitors in Switzerland, Google Tag Manager loads when the page is opened; cookies for statistics and marketing are only set after your consent. For all other visitors (identified by the device’s time zone), Google Tag Manager only loads once you have allowed statistics or marketing; before that, no request is sent to Google or Meta. The legal basis for cookies and measurement is your consent, which you can withdraw at any time in the cookie settings.

This website is operated by Vercel Inc., USA, and delivered via its global network. The server functions run in Frankfurt (Germany). When you visit the website, the access data listed in section 1.1 is generated, which Vercel stores in logs for delivery and security. Content, enquiries and newsletter subscriptions are stored in a Neon database, images and files in Vercel Blob, both in the Frankfurt region (Germany).

We draw the maps with our own map tiles from OpenStreetMap data, stored on our server. No request is sent to a map service. We also serve fonts and videos ourselves, without Google Fonts, YouTube or Vimeo.

Some location pages offer a 360° tour from Matterport (Matterport, Inc., USA). It only loads when you click on the preview image; Matterport then receives your IP address and Matterport’s privacy policy applies.

Links to Google Maps, WhatsApp, Instagram, LinkedIn, the App Store and Google Play are simple links. Data is only sent to the respective provider when you click a link.

Some of the providers mentioned process data outside Switzerland and the EU, in particular in the USA (Google, Meta, Mailchimp, Shopify, Vercel, Matterport). Recipients in the USA that are certified under the Swiss-US or EU-US Data Privacy Framework offer an adequate level of data protection. Where this certification is missing, we rely on the standard contractual clauses of the European Commission, which are also recognised by the Federal Data Protection and Information Commissioner (FDPIC), or on a statutory exception such as your consent.

We only keep personal data for as long as is necessary for the respective purpose: enquiries until they have been dealt with and beyond that only where statutory retention obligations or legitimate interests such as evidence purposes exist; newsletter subscriptions until you unsubscribe; your cookie choice until you change it or delete the website data in your browser.

You have the right to information about your personal data, to the correction of inaccurate data, to erasure, to the release or transfer of your data in a common electronic format and to object to processing. Where the GDPR applies, you also have the right to restriction of processing. You can withdraw consent at any time with effect for the future. Please contact hallo@padelwerk.ch.

You can also lodge a complaint with the Federal Data Protection and Information Commissioner (www.edoeb.admin.ch) and, from the EU, with the data protection authority of your country.
